GENERAL CONDITIONS OF USE

The access to this Site implies the acceptance of the conditions of use by the User.

USER REGISTRATIONS

Registering is an optional condition for the acquisition of products through this Site. For the registration process the Customer must enter a username and password. The data provided in this process will be processed under the terms indicated in the section of Privacy Police accessible in this Site.

However, be aware that from PIEDRA we reserve the right to exclude on an unilateral basis, temporary or definitively any User from the operativity of his/her account when we detect that this User violates any of the present conditions of use.

PURCHASE PROCESS IN PIEDRA

Once the purchase process is finalized, an e-mail will be sent from PIEDRA to confirm immediately the reception of the acceptance of the order to the address the User has provided.

In the final price the correspondent amount to taxes and shipping costs will be indicated.

Any customs charges will be paid by the customer.

The following payment methods are supported: PayPal and credit card. When choosing PayPal an e-mail will be sent to the User from PayPal confirming the payment. If choosing credit card, the payment gateway from the bank will confirm if the transaction is approved.

The credit cards accepted are Visa and Mastercard.

DELIVERY TERRITORIAL AREA AND GUARANTEE

The products purchased will be shipped directly from PIEDRA through a shipping company with guarantees.

The shipping costs and delivery time of our products depend on the delivery destination:

Spain*, Andorra and Portugal*: 12 € / 2-4 working days

In August, delivery times can increase up to 7 days to the usual ones.

For causes outside control (for example, strikes in the sector, etc) the delivery terms may increase up to 30 days. However, this lead time is rare and it is due to applicable regulation.

PRODUCTS AVAILABILITY

All orders are subject to the availability of products. In case the product is not available once the order is placed, the customer will be informed via e-mail and a refund for the amount paid will be made within 24 hours.

DAMAGED PRODUCT

From PIEDRA we always try to offer the products in the best possible conditions. Some products might present small imperfections on the sole due to the process of trying them in our store. This will not be considered a default.

If the product suffers from any damage due to transport, the customer must report to PIEDRA promptly and to the supplier upon delivery. The customer has the right to guarantees and service after-sales stablished by the Consolidated Draft of the General Law for the Protection of Consumers and Users and other complementary laws (RDL 1/2007, November 16th), in its articles 114 and following.

EXCHANGES AND RETURNS. RIGHT OF WITHDRAWAL

If wishing an exchange of size or return, the customer must make a request in a period of 15 days after receiving the order.

The products must be returned in its original packaging, with all its accessories (if it had any), and in perfect condition. In case of return, the shipping and returning costs will not be reimbursed (including customs fees).

In order to inquire about the procedure of exchange in your country or area, you can send an e-mail to shop@piedrastore.com.

Reimbursement: Once received the products returned, the customer will receive the reimbursement for the same amount of the products purchased but the shipping and returning costs. The customer will not be charged for these costs when the reason for the return is due to defective products (in the cases that the return is not imputable to this part).

From PIEDRA we will proceed to the reimbursement under the same procedure as the one used for the payment within 72 hours since the confirmation of the received products in the warehouse.

 

PLACE OF DELIVERY, TERMS AND CASE OF LOSS

I- Delivery of the product: The product or products ordered will be delivered to the provided address by the customer in the Order Form in this Site. Delivery will be made to the address specified by the customer during normal business hours. PIEDRA is not responsible for the troubles caused in the delivery when the address provided by the customer in the Form of this Site does not adjust to reality or there are any details of the address missing.

II- Delivery time: In order to know the order status, the customer can contact PIEDRA at shop@piedrastore.com

Once the order has left from our warehouse PIEDRA will send an e-mail to let the customer know about the status of the order.

Each delivery is considered complete since the shipping company makes the order available to the customer. This is recorded by the control system used by the shipping company.

If there was any delay in the delivery attributable to this entity, the customer will be able to cancel the order in accordance to the return process. It will not be considered as delays these cases in which the order has been made available to the client by the shipping company on the arranged terms and the shipping company has not been able to deliver the order due to circumstances for which the customer is accountable.

III – Delivery terms, unrealized delivery and misdirection: If the customer is absent at the moment of the delivery, the shipping company will leave a slip indicating how to proceed for a new delivery or where the order should be collected from.

If passed 7 days since the slip is left and the customer has not been in contact with the shipping company, the order will be sent back to our warehouse and the customer will cover the delivery and return costs, as well as of any other related management costs.

IV – Delivery diligence: The customer must verify the good conditions of the package in front of the messenger of the shipping company and indicate in the delivery note any anomaly detected in the packaging.

APPLICABLE LAW AND JURISDICTION

Finally, PIEDRA indicates that in the event of any discrepancy or controversy with regards to the interpretation or application of these Conditions of Use, the parties expressly waive any other code of laws that might pertain to them and agree to submit to the jurisdiction and authority of the Courts and Tribunals of the city of Barcelona (Spain). These Conditions shall be governed in all cases by the Spanish legislation.
